State Supreme Court to Consider Banning Ranch Lawsuit

Arguments are scheduled to be heard this week by the California Supreme Court over Newport Beach, CA’s approval of the Banning Ranch development. A lawsuit by the The Banning Ranch Conservancy challenged the project proposed on 401 acres of coastal land in West Newport, which has been an active oil field since the 1940s.

The most recent development plans, submitted by Newport Banning Ranch, include 895 homes, a 75-room hotel, a 20-bed hostel and 45,100 square feet of retail space on 62 acres. An earlier proposal included 1,375 homes, a 75-room hotel and commercial space on roughly 95 acres.

The conservancy wants to acquire and manage the property for public use, but the market value must be ascertained. The developer is also challenging a state coastal commission ruling on the project, and requesting damages of at least $490 million.
