State Court Tosses Challenges to Three-Tower LES Project
The Appellate Division of New York State Supreme Court unanimously reversed the lower-court rulings that had prevented developers from moving forward with their proposed projects in the Lower East Side’s Two Bridges neighborhood due to lawsuits from a pair of community groups.
The state court ruled that the New York City Planning Commission had acted properly in not putting the three-tower mega-project through the public review process.
Fried Frank has now represented the development team—Starett Development LLC, JDS Development Group, CIM Group, Inc., L+M Development Partners, and Two Bridges Senior Apartments, LP—in four separate Article 78/declaratory judgment proceedings that have been brought challenging the CPC’s approvals.
The Fried Frank team representing the developers included real estate and litigation partner Janice Mac Avoy, real estate partner David Karnovsky, real estate special counsel Wesley O’Brien, and litigation associates Kristin M. Whidby and Ben Paull.
