State Court Tosses Challenges to Three-Tower LES Project

The Appellate Division of New York State Supreme Court unanimously reversed the lower-court rulings that had prevented developers from moving forward with their proposed projects in the Lower East Side’s Two Bridges neighborhood due to lawsuits from a pair of community groups.

The state court ruled that the New York City Planning Commission had acted properly in not putting the three-tower mega-project through the public review process.

Fried Frank has now represented the development team—Starett Development LLC, JDS Development Group, CIM Group, Inc., L+M Development Partners, and Two Bridges Senior Apartments, LP—in four separate Article 78/declaratory judgment proceedings that have been brought challenging the CPC’s approvals.
