BXP Wins Court Ruling on Building AstraZeneca Lab Tower 

Boston Properties Inc. (BXP) can continue constructing AstraZeneca’s Kendall Square lab tower despite Brammer Bio Inc.’s objections, Boston Business Journal. Suffolk County Superior Court Judge Kenneth Salinger ruled that the construction at 290 Binney St. won’t block access to Brammer’s loading docks at 250 Binney St., rejecting Brammer’s request to halt the project.  

Brammer, a Thermo Fisher subsidiary, claimed the construction would disrupt its operations and violate its sublease. However, the judge found no basis for these claims, noting that BXP’s easement allows roadway reconfiguration and partial tower construction on the disputed property.  

Thermo Fisher expressed strong disagreement with the ruling and is evaluating legal options. The lawsuit also includes allegations of trespassing and operational interruptions due to construction. However, Judge Salinger found no basis for these claims, noting that BXP had taken steps to minimize inconvenience. The judge upheld the validity of a BXP affiliate’s recent easement change to facilitate the construction. Thermo Fisher disagrees with the ruling and is evaluating legal options.
