Healey Signs Order Requiring Local Approval for Data Center Projects
Massachusetts Gov. Maura Healey on Tuesday signed an executive order requiring local approval for data center projects before they can be cleared by state permitting agencies. Healey’s order also requires data center developers to comply with her Data Center Framework, to include bringing their own clean energy supply or paying fees that will be returned to utility customers, protecting water resources and engaging transparently with the surrounding communities.
“Unless a community says yes to a data center, we are saying no,” said Healey. “We’re giving communities a voice and laying out the rules for what needs to happen in Massachusetts. I’m also making sure these data centers use clean energy, and that we protect people from higher energy costs – including by returning money directly back to ratepayers.”
The order requires developers to reach a community benefits agreement with the host community that adheres to state standards before moving forward with any state permitting processes. It also prohibits non-disclosure agreements between the developers and state agencies.
