Fire Up the Barbecue in NYC Again

NYC’s recent crackdown on rooftop and terrace spaces appears to be easing. Building owners received notice from the city’s Department of Buildings that it would again allow “recreation spaces.”

That seems to reverse the DOB’s decision to require all floor areas used by tenants to be “enclosed.” That ran counter to the trend of creating such amenities as roof decks and outdoor terraces at existing properties as a way to attract renters. It would have also restricted residential buildings from having outdoor areas, too.

The latest interpretation of the building code allows outdoor spaces for 74 or more people if the certificate of occupancy is amended and proper egress is provided. No paperwork is needed for smaller spaces.
