Judge Nixes Permits for Upper West Side Condo Tower

A state Supreme Court judge in Manhattan voided the city’s permits for Extell Development’s  luxury condominium project at 50 W. 66th St. on the Upper West Side, Crain’s New York Business reported.

The project plans violated zoning laws by proposing “gargantuan mechanical spaces” that are mostly empty in the middle of the building simply to inflate the building’s height and skirt the zoning height limits, Judge Arthur Engoron wrote in his decision.

The developer, which also built Central Park Tower and One57 on Billionaires Row, planned to build 39 stories 775 feet in the air, a height which would have made the Snøhetta-designed 50 W. 66th the tallest in the neighborhood.

That distinction currently belongs to 200 Amsterdam, where developers—in order to meet zoning regulations—might have to remove 20 stories that have already been built, reported Crain’s. Extell reportedly plans to appeal Engoron’s ruling.
